Terms & Conditions

Last updated: October 18, 2026

These Terms of Service apply to tonymccabe.com, operated by Tony McCabe (“we,” “us,” or “our”), and purchases made directly from us. Read the product or service description and applicable policies before placing an order.

Use of the site

You must be at least 18 or the legal age of majority to purchase services or enter a contract. If acting for a business, you must have authority to do so. Use the site lawfully and do not interfere with security, impersonate others, introduce malicious software, or infringe anyone’s rights.

Protect your account credentials and tell us promptly about unauthorized access. You are not automatically responsible for activity for which applicable law places responsibility elsewhere.

Orders and payments

The product or enrollment page describes what you are buying. Prices, billing currency, applicable charges, and payment schedule must be disclosed before purchase. A subscription requires your express agreement to recurring charges; merely visiting the site does not authorize a payment.

If we cannot accept or fulfill an order, we will notify you and refund any amount collected for the unfulfilled order. A pricing error does not authorize an increased charge without your agreement.

Shipping, returns, and Amazon orders

Direct purchases are covered by our Shipping Policy and Return and Refund Policy. These policies include 30-day returns for eligible unused physical goods, a 14-day digital refund option, and refunds for unused coaching services.

Purchases completed on Amazon are governed by the terms and seller information shown there, subject to applicable law. Use the Amazon order page for delivery and return assistance.

Coaching and advisory services

Our services provide education, business perspective, and accountability. The agreed program description defines sessions, deliverables, duration, and fees. We do not guarantee revenue, profit, funding, or other specific results.

You remain responsible for business decisions. Coaching is not a substitute for legal, medical, mental-health, tax, or regulated investment advice. Refer to our Disclaimer and consult a qualified professional where appropriate.

You may end services and request a refund for the unused portion under our Return and Refund Policy. Any separate service agreement must be supplied and accepted before it changes the terms of your purchase. We do not impose undisclosed fees.

Membership billing and benefits

Private Access and other recurring memberships renew at the interval and price expressly accepted at enrollment until canceled. Any trial, introductory price, later price, minimum commitment, and renewal date must be disclosed before you agree. An annual plan is charged annually unless its offer states a different agreed payment arrangement.

Benefits are those described in the offer you purchased. Private Access includes its advertised member content, archive access, member pricing, and first notice of program availability. Priority notice does not guarantee admission or a reserved place. Contact us before purchase if you need help applying a promised member benefit.

Canceling a membership

Cancel anytime to stop future renewals using the cancellation option in the account or payment service managing your membership. You may also email contact@tonymccabe.com or submit the contact form. No telephone call or explanation is required for these written requests. We treat cancellation as effective when received and will confirm it.

Access continues until the end of the paid period. Partial-period refunds are available where required by law, for billing errors or service failures, and when you request immediate termination with a daily prorated refund for unused time. Charges made after a timely cancellation request will be refunded.

We will provide renewal reminders, annual reminders, trial-ending notices, and notices of price or material changes where required by applicable law. Price increases will not apply retroactively, and you may cancel before they take effect. Any further consent required by law will be obtained.

Content and digital-product licenses

Our original writing, books, images, and materials are protected by intellectual-property law. A digital purchase grants personal, nonexclusive use of the purchased material. Do not resell, publicly redistribute, or claim ownership of it. This does not restrict fair use or other rights provided by law.

You retain ownership of material you submit. Permission to display a public comment extends to displaying and moderating that comment; it does not automatically grant us permission to use private coaching communications as advertising. We will seek permission before publishing an identifiable client testimonial.

Privacy and third-party services

Our Privacy Policy and Cookie Policy explain our published data practices. Third-party sites and payment services have their own terms. Linking to another site does not guarantee its content or performance.

Information, results, and legal protections

Read our Disclaimer for the educational scope of our content. Examples and testimonials do not guarantee your results. We remain responsible for promises we make and obligations imposed by applicable law.

Nothing in these Terms excludes nonwaivable consumer rights, applicable warranties, or liability that cannot lawfully be excluded. We do not require mandatory arbitration, waive class-action rights, or restrict honest consumer reviews through these Terms.

Suspension and service changes

We may restrict access reasonably necessary to address fraud, security threats, unlawful activity, or a material breach. Where practical, we will explain the issue and provide an opportunity to correct it. If we discontinue a prepaid service, we will refund the unused portion; we will not retain payment for services we do not provide.

Applicable law and updates

California law governs to the extent permitted by applicable law. This does not deprive you of mandatory protections or access to courts provided by the law that applies to you.

Updates apply prospectively and do not reduce existing purchase rights. Material changes to an ongoing paid service will be communicated before they apply, with any consent or cancellation opportunity required by law. If a provision is unenforceable, the remaining provisions continue to apply.
